Eligibility as per the new Surrogacy 2021 ACT

Intended Couple Criteria*

  • In Married Couple, Indian man should be between 26 and 55 years of age
  • In Married Couple, Indian Woman should be between 23 and 50 years of age
  • Single woman (defined as widowed or divorced) is permitted
  • Couple can also be of Indian Origin (both should hold OCI cards)
  • Should apply in their resident District Ward
  • Single woman can use sperm donor (not egg donor)
  • Egg Donor cycles are ALLOWED
  • Couple cannot have a previous healthy child
  • Can transfer embryos from one clinic to another within India
  • Cannot import embryos from another country into India
  • Sex selection not allowed
  • Obtain Certificate of medical indication from District Medical Board
  • General Health Insurance for 36 months, for the Surrogate mother
  • Gaurantee of compensation for SM in case of complications Affidavit
  • Parental Order passed by First class Magistrate for the Couple and Surrogate
  • Obtain Certificate of Essentiality from the Board
  • To undergo Surrogacy from a registered Surroacy Clinic under the new ACT

Surrogate Mother Criteria

  • SM should be between 25 and 35 years
  • SM should be an Indian Citizen
  • She should be an ever married woman
  • Should be a willing woman to undergo Surrogacy
  • SM should have given birth to a child
  • She should not be genetically linked to the child born through surrogacy
  • SM should possess Medical and psychological fitness certificate
  • SM can act as a Surrogate only once in her lifetime
  • SM can undergo Embryo Transfer thrice for the same couple to achieve pregnancy
  • SM Eligibility Certificate from Appropriate Authority
  • She should present herself in the court for parental order

How to take care of surrogate mother

The Best Antenatal Care

Pre pregnancy health

We suggest to keep surrogates admitted at any clinic for minimum 15 day, to avoid any physical exertion, and to avoid relationship with their husband till the beta (bHCG) test is performed to confirm the pregnancy status. Once surrogate is pregnant extend her stay further by 15 days, till the number of sacs and cardiac activity is established.

Frequent Ultrasound Sonographies

In the initial weeks, scans to be done on a weekly basis to rule out any early pregnancy concerns. In second trimester, scans to be done fortnightly, including Malformation / Anomaly scans. Again in third trimester, the scans are performed more frequently.

Routine Investigations

Perform all routine blood tests, including systemic tests like thyroid, diabetes, renal function, liver function test and Infectious screening for both surrogate and her husband.

Genetic Screening

To rule out chromosomal abnormalities in the foetus, to do, double maker NFT scan at 12 weeks, and malformation scan at 19 weeks.

Obstetric Visits

Monitors her BP, pulse, weight, routine obstetric check, and advise for further management. To continue iron, calcium, vitamins, minerals, protein biscuits and protein powder.

Planning Delivery

The date is always planned with parents consent to make sure they are present at the time of delivery to experience most beautiful movement of their life, unless in cases of emergency.

Mullerian agenesis (Mumbai)

Patient was born without the uterus and small vagina. Stimulated, got 3 embryos, and surrogate got pregnant and they have healthy child

Multiple Miscarriages (Mumbai)

Not 1 or 2 but 4 miscarriages between 12 – 26 weeks. It was uterine factor and surrogate got pregnant in first attempt, delivered healthy child.

Multiple failed IVF cycles (Mumbai)

8 failed IVF cycles, 4 IUI cycles and still childless. Went through surrogacy to get a child in first attempt.

Autoimmune disorder (Mumbai) 

ANA, Antiphospholipid and other sensitive markers came positive.

Pre-eclampsia (Mumbai) 

Lost 2 kids due to hypertension at 24 & 26 weeks. Did 1st surrogacy to become parents.

Breast cancer (Mumbai) 

Already struggling with a cancer, she did surrogacy to ensure her treatment and her struggles dont define her parenthood.

Heart lung transplant (Sweden) 

First such case in the world, where we cautiously stimulated the patient with heart lung transplant, just to get 3 eggs, 3 embryos, and they took a healthy child back in 2012.

Primary pulmonary hypertension (Norway) 

Arguably first such case to undergo stimulation and egg pick up. Minimal stimulation resulted in 3 eggs, 3 embryos, and one baby born in 2011.

Paraplegia (paralysis of abdomen and lower hips) (Mumbai) 

Lost her parents, became paraplegic, in car accident post her 10th grade. Most difficult egg pick up, with bilateral frozen hips got pregnant in first attempt.

Peripartum cardiomyopathy (Canada)

Developed cardio myopathy post first delivery, she had no choice but to go for surrogacy. Got eggs and baby in first attempt in 2009.

Type A diabetes with retinal involvement (Australia) 

Patient with childhood diabetes, progressed to severe loss of vision, and nephropathy. Got pregnant in first attempt.

Ovarian translocation (USA) 

Hysterectomy performed at the age of 23 for cervical cancer with abdominal translocation of ovaries. Laparoscopic egg pick led to a healthy child.

IVM cycle (Hungary) 

Due to restrictive medical condition, had to do egg pick up on day 8, let the eggs mature in vitro (through ivm process), fertilized with sperms and got beautiful embryos

C2 complement deficiency (Canada) 

Oldest living woman with this (rare) condition (only 8 such cases diagnosed in world), now a mother of 3 beautiful children through two different attempts of surrogacy.

Yes, only if medical indicated. No person, organization, surrogacy clinic, laboratory, or clinical establishment can force the surrogate to abort.

Yes, the surrogate mother can withdraw her consent but only before the implantation of embryos.
